dc.description.abstractEl presente trabajo de investigación, se realizó con el fin de hacer el estudio comparativo de los marcos legales que regulan la manipulación genética en Argentina y Colombia, para lo cual se hizo una revisión bibliográfica que permitió identificar autores, leyes y documentos en temas relacionados con: el marco legal de protección al embrión, los derechos a la protección de la persona desde su concepción, la Constitución Nacional y el Narciturus, el nivel jerárquico superior a la legislación interna de las naciones sobre manipulación genética, el marco jurídico sobre la protección a la discriminación genética, la fertilidad asistida, la manipulación genética humana y el Derecho Penal. Este cúmulo de conocimientos y relaciones dieron las bases para lograr determinar cuáles son las diferencias y las similitudes de los marcos que regulan el tema de estudio en los países objeto de estudio. Igualmente permitieron comparar estas acciones legislativas, obteniendo conclusiones importantes acerca de las formas de regulación génica de tipo germinal, somática, perfectiva, eugenésica y de clonación que se encuentran presentes en la Constitución Nacional, el Código de Derecho Civil y el Código Penal de Argentina de Colombia respectivamente.spa
dc.description.abstractenglishThis research work was carried out in order to make a comparative study of legal frameworks governing genetic manipulation in Argentina and Colombia, for which was a literature review that identified perpetrators, laws and documents related topics : the legal framework for the protection of the embryo, the rights to protection of the person from conception, the Constitution and Narciturus, superior to the domestic law of nations on genetic manipulation hierarchical level, the legal framework on protection genetic discrimination, assisted fertility, human genetic manipulation and criminal law. This body of knowledge and relationships gave the basis for achieving identify the differences and similarities of frameworks governing the subject of study in the countries under study are. They also possible to compare these legislative actions, obtaining important conclusions about the forms of gene regulation germ, somatic, perfectiva, eugenic type and cloning are present in the Constitution, the Code of Civil Law and the Criminal Code of Argentina of Colombia respectively.eng
