dc.description.abstract	Esta investigación se planteó como objetivo verificar la operatividad de la consulta previa, mediante estudios de caso a comunidades indígenas y afrodescendientes en la ejecución de proyectos que afecten la integridad física, ambiental, territorial y cultural de estas comunidades. El enfoque de esta investigación fue cualitativo de tipo descriptivo y partió de la revisión documental. Se pudo comprobar que la vulneración a los derechos de las comunidades indígenas y afrodescendientes es constante por parte de empresas y particulares que llegan a sus territorios a explorar y extraer los recursos naturales causando gran afectación del entorno y de sus habitantes. Los afectados han hecho uso de la consulta previa logrando en algunas ocasiones que se ordene el cese de actividades mineras y protegiendo los derechos vulnerados. Ante los resultados positivos que han conseguido las comunidades con este instrumento desde diversos sectores se está tratando de presionar para que las comunidades no puedan hacer uso nuevamente de la consulta previa para frenar proyectos mineros.	spa
dc.description.abstractenglish	This research was intended to verify the operability of the previous consultation, through case studies of indigenous and Afro-descendant communities in the implementation of projects affecting the physical, environmental, territorial and cultural integrity of these communities. The approach of this research was qualitative of a descriptive type and began from the documentary review. It was found that the violation of the rights of indigenous and Afro-descendant communities is constant on the part of companies and individuals who come to their territories to explore and extract natural resources causing great impact on the environment and its Inhabitants. Those affected have made use of the prior consultation, sometimes ordering the cessation of mining activities and protecting the rights infringed. In view of the positive results that communities with this instrument have achieved from various sectors, an attempt is being made to push so that communities cannot make use of the previous consultation again to stop mining projects.	eng
